By submitting your design and in consideration of the Daniel Schäfer & Markus GbR (hereinafter Artwork Junkies) evaluating your design for its possible use on clothing (hereinafter Item) you agree to the following conditions of participation:

  1. In case your Design is selected for use by Artwork Junkies, you accept that you assign to Artwork Junkies the rights to the title and the copyright of your Design including the right to sue for past infringement and the right to further sublicense the Design  for its exclusive use on and in connection with the Item.
  2. If your Design is selected Artwork Junkies may use your Design in connection with the Item, including but not limited to: reproducing the Design on the Item, selling the Item with the Design on it, making changes to the Design in particular affecting its size or color and using the Design on the Artwork Junkies website. You agree to supply Artwork Junkies without any further costs with information required in order to register the copyright of the Design if Artwork Junkies choses to do so.
  3. You are allowed to use the Design for any other purposes except those listed below.
  4. If your Design is chosen, you are not allowed to use the Design (or derivatives of the Design) or allow others to use the Design (or derivatives of the Design). By submitting your Design you are not allowed to sell, reproduce or submit the Design to others for any commercial purpose for 60 days after the date of submission while the Design is being evaluated by Artwork Junkies. If the 60 days have expired and Artwork Junkies has not chosen your Design you may use the Design for any commercial or non-commercial purpose. In case your Design is used anywhere else you must notify Artwork Junkies by writing an email to submissions@artworkjunkies.com about when and where the Design will be used so that it can be deleted from Artwork Junkies. You agree not to use the Artwork Junkies websites to promote the services and products of any company that operates in competition with Artwork Junkies.
  5. You accept that Artwork Junkies can decline to select a Design for consideration for the following reasons. Artwork Junkies wants every design to have the best chance possible to be selected for one of our awards. If we think your Design still needs some work before placing it in our contest you will be notified by Artwork Junkies. Also your Design can be declined if Artwork Junkies thinks that  the theme of your Design is not suitable for our community. Furthermore your Design can be declined if Artwork Junkies assumes that your Design is in conflict with any applicable law.
  6. You acknowledge that you have not granted any license of the Design to any third party, it is your own original work, does not contain any logos, copyrighted material, trademarks or any other intellectual property belonging to any third party or any material which Artwork Junkies in its sole discretion deems to be profane or offensive.
  7. If your Design is selected for use by Artwork Junkies you grant Artwork Junkies the exclusive right to produce and sell 500 units and furthermore grant Artwork Junkies the option to retain permanent exclusive rights to your Design. You will receive 1,- € in cash for every sold Item. If your design gets chosen to win the shirt of the week award you will receive 75,- € cash and a 25,- € gift certificate. If your design is selected for the shirt of the week award you will automatically be entered into the shirt of the month contest and become eligible to receive an additional 300,- € in cash and a 100,- € gift certificate. At the end of every year each of the 12 Designs that were elected shirt of the month will compete in the shirt of the year contest and the designer will become eligible to receive an additional 1.000,- € in cash. Additionally you will receive 1.000,- € in cash if your Design is chosen to be used more than 500 times and Artwork Junkies uses its option to retain permanent exclusive rights.
  8. Artwork Junkies reserves the right to change these payment terms at any time by posting them on the Artwork Junkies website and changes will be effective upon posting. Payment will be based on the terms in effect when your Design is selected. You alone will be responsible for the payment of any taxes that arise as a result of receiving payment from Artwork Junkies. Payment will be sent within the first 10 business days the month after Artwork Junkies receives the high resolution artwork deemed suitable for print. If the high resolution artwork is not deemed suitable for print as determined by Artwork Junkies, you will be notified about the reason(s) for its determination by email and will make a good-faith effort to assist in presenting a suitable high resolution format.
  9. Participants who do not comply with these conditions of participation can at any time be excluded from consideration without notice.
  10. The decisions of Artwork Junkies are final and binding.
